655 REHEARSAL STUDIOS – TERMS & CONDITIONS

Please read these Terms and Conditions carefully before booking or using our facility. By completing a booking, you agree to be bound by these rules and policies.

1. RENTAL TERMS & CONDITIONS

  • License to Use: 655 Rehearsal Studios (the “Company”) grants the User a temporary, non-exclusive license to use the designated space for the scheduled booking duration. This is a license to use space; not a lease or tenancy.

  • Payments & Additional Charges: Sessions must be paid in full at booking. By completing a booking, the User authorizes the Company to charge the payment method on file for any additional fees incurred during the session, including but not limited to: property or equipment damage, specialized cleaning fees, or session time overages.

  • Cancellations & Rescheduling: Requests for refunds or rescheduling for standard single sessions must be made at least 24 hours in advance of the scheduled session start time.

  • Prepaid Bulk Package Expiration: All bulk packages, punch cards, and prepaid blocks of time feature a strict 12-month structural expiration window from the exact date of financial purchase. Any remaining unbooked or unredeemed hours after this 365-day period are permanently forfeited without exception or cash value substitution.

  • Explicit Non-Refundability Shield: Prepaid bulk packages are sold as a unified, volume-discounted asset block. All sales are final. No partial or full cash refunds will be issued under any circumstances, including but not limited to band dissolution, individual member scheduling changes, or relocation outside the serving area.

  • Strict Package No-Show & Late-Cancel Deduction: Booking appointments using a bulk package code remains strictly bound to the standard 655 Studios 24-hour cancellation window. Failure to cancel or reschedule a booked block at least 24 hours prior to the session start time will result in the immediate, automated deduction of those full scheduled hours from your remaining package balance.

  • Security: User is responsible for facility security and room security during their session. The entire facility is under 24/7 video surveillance.

2. GENERAL LIABILITY WAIVER & RELEASE

  • Assumption of Risk: User acknowledges inherent risks involved in a rehearsal environment, including high decibel levels, specialized electrical equipment, and trip hazards.

  • Hearing Safety: User is solely responsible for their own hearing protection and the protection of their guests. The Company is not liable for any hearing damage or loss.

  • Release: User releases and discharges 655 Rehearsal Studios and its owners, officers, and staff from all liability, claims, or demands for personal injury or property damage.

  • CA Civil Code Section 1542: User expressly waives all rights under CA Civil Code Section 1542, which protects against unknown claims at the time of signing a release.

3. EQUIPMENT USE & DAMAGE POLICY

  • Backline Condition: User agrees gear is in good working order at the start of the session and acknowledges the specific Backline Manifest and replacement values for the selected room.

  • Financial Responsibility: User is fully liable for any and all damage to the gear, equipment, or facility structural property that goes beyond reasonable wear and tear. This includes, but is not limited to: blown speakers, structural impact damage, broken hardware, or liquid spills.

  • Prohibited Actions: No DIY repairs, tube swapping, or gear removal from the designated room are permitted under any circumstances.

  • Reporting: Pre-existing damage must be reported immediately upon entering the room via the provided contact methods, or the User may be held responsible for those damages.

4. HOUSE RULES & CODE OF CONDUCT

  • The Clock: Session time includes both load-in and load-out. Rooms must be completely clear of personnel and personal gear by the end of the scheduled block.

  • Substance Policy: Smoking, vaping, illegal substances, and alcohol are strictly prohibited inside the facility at all times.

  • Occupancy Rules: Maximum room occupancy limits must be strictly followed at all times. The limits are capped as follows:

    • Small Room: Maximum of 5 people.

    • Medium Room: Maximum of 8 people.

    • Large Room: Maximum of 10 people.

  • Doors Closed Policy: Performance and rehearsal room doors must remain completely closed at all times while instruments, amplifiers, or audio playback systems are in use.

  • Community & Conduct: Keep hallway noise to a minimum. Treat the space, the Upland neighbors, and other guests with respect.

  • Zero Tolerance & Right to Eject: Users and their guests must be polite, professional, and respectful toward 655 Rehearsal Studios staff and others on the premises. The Company and its staff reserve the absolute right to terminate any session immediately and eject anyone from the property at any time for abusive behavior, non-compliance with rules, safety violations, or general disruption, without a refund.
